The Federal Board of Revenue (FBR) has taken a historic step by launching a large tax relief program designed to help Overseas Pakistanis in the real estate industry. By addressing several tax issues and offering exemptions, this new policy opens up investment options and lessens the financial strain on Pakistani expats.

Key Highlights of the Initiative

The FBR’s latest step is part of its ongoing efforts to enhance tax compliance and simplify procedures for Overseas Pakistanis. Here are the main features of the initiative:

  1. Income Tax Exemption: Overseas Pakistanis holding a valid POC (Pakistan Origin Card) or NICOP (National Identity Card for Overseas Pakistanis) can now claim income tax exemption on property transactions, provided they are listed on the FBR's Active Taxpayers List (ATL). This exemption is granted under Section 236C of the Income Tax Ordinance, 2001.
  2. Active Taxpayer List Requirement: To receive this benefit, you must be included in the Active Taxpayers List (ATL FBR). Those not on the list may face higher withholding taxes during property transactions, underscoring the importance of maintaining active taxpayer status.
  3. Tax Relief on Property Sales: In 2024, the tax on the sale of property in Pakistan has been significantly reduced for Overseas Pakistanis who meet the ATL criteria. This aligns with the government’s vision to encourage diaspora investment in the real estate sector.
  4. Simplified Tax Exemption Certificate: The process for obtaining a tax exemption certificate has been streamlined, making it more accessible for expatriates to benefit from income tax exemptions in Pakistan.
  5. Digital Verification System: To further facilitate Overseas Pakistanis, the FBR has launched a digital verification system via its IRIS platform. Non-resident Pakistanis can upload their POC or NICOP details when generating a Computerized Payment Receipt (CPR). The verification process is designed to be completed within one business day.
  6. Nationwide Accessibility: The initiative is accessible through Large Taxpayer Units (LTOs), Medium Taxpayer Offices (MTOs), Corporate Tax Offices (CTOs), and Regional Tax Offices (RTOs) across Pakistan.

Incentives for Compliance

Overseas Pakistanis can take advantage of these benefits by ensuring their compliance with FBR regulations:

  1. Registration with FBR: Ensure timely filing of income tax returns to be listed on the ATL.
  2. Collaboration with Tax Offices: Tax offices have been directed to efficiently facilitate taxpayers' obtaining exemptions and complying with tax laws.

FBR Property Valuation Updates

Another essential component of this endeavour is the updated FBR valuation of real estate, which considers current market developments. This modification ensures equity in real estate transactions by giving the tax calculation a more accurate foundation.

Boost to Real Estate Investment

The government hopes to create a more favourable investment climate by reducing tax costs and streamlining compliance, which is anticipated to increase real estate investments by Overseas Pakistanis, who have long been essential contributors to the nation's economy.

Conclusion

The FBR's recent tax reduction program for Overseas Pakistanis demonstrates the government's dedication to aiding expatriates and promoting their active involvement in Pakistan's economic development. Pakistanis living abroad may invest in real estate confidently and save a lot of money on taxes by taking advantage of these advantages. To fully benefit from this program, you must remain on the Active Taxpayers List and secure the required exemptions.
